Search & Seizure
Every employer is entitled to take reasonable steps to protect its assets, and therefore also has the right to search employees and their personal belongings. Where necessary, an employer may seize such belongings. At Rhodes, CCTV facilities are used across campus as a security measure, the system primarily aimed at enhancing the safety and security of staff and students.
These measures however must be done with due consideration of the South African Constitution, (Act 108 of 1996), and in particular the individual’s right to dignity and privacy. Section 36 of the Constitution however states that the right to privacy may be limited where a legitimate purpose is to be served and the limitation is reasonable and justifiable.
