COMMERCIAL LAW
2012 - 2013
A new curriculum for Commercial Law is being phased in during 2012 and 2013 in order to ensure compliance with the requirements of the South African Institute of Chartered Accountants (SAICA).
Commercial Law 1 (COL 1)
COL 1 consists of two one?credit semester courses, COL 101 and COL 102. These courses will have new curricula from 2012, brief descriptions of which are set out below (for more detail in this regard, see the Commercial Law 1 course materials).
COL 101 Introduction to law; the law of contract, including special contracts; the administration of deceased estates; the law of insolvency.
COL 102 Introduction to business entities; company law; corporate governance; black economic empowerment.
Students who fail COL 101 and/or COL 102 in 2011 may register for the new curricula COL 101 and/or COL 102 in 2012 in order to complete Commercial Law 1.
Commercial Law 2 (COL 2) - 2012
The existing COL 201 and 202 courses will be offered for the last time in 2012, and will have the same curricula as in 2011. The 2012 curricula will be:
COL 201
Paper 1: Sale, Lease and Carriage
Paper 2: Administration of Estates; Insolvency and winding-up of companies and close corporations.
COL 202
Paper 1: Selected topics in company law; Forms of payment.
Paper 2: Property transactions; The law of security; Insurance; Marketing; Introduction to arbitration.
All students who fail COL 201 and/or COL 202 in 2012 will be given supplementary exams.
Accounting students who fail COL 201 and/or COL 202 supplementary examinations will be required to take one or both (as necessary) of the two new semester courses offered in the Accounting stream (Introduction to Professional Accounting and Introduction to Taxation).
Students who are not in the Accounting stream and who fail COL 201 and/or COL 202 supplementary examinations will be advised to either (i) register for one or two (as necessary) second year semester credits (one of which may be the new COL 201) or (ii) register for a substantially equivalent Unisa course (or courses) which Rhodes will recognise and for which Rhodes will pay – provided that Unisa offers such course (or courses).
Commercial Law 201 (COL 201) – from 2013
From 2013 there will be a new COL 201 course offered, but there will be no COL 202 course. From 2013 the COL 201 curriculum will be:
Labour law; Real and personal security; Intellectual property and franchising; Banking law and payment instruments; Credit agreements and consumer protection; Commercial crimes.
