Negligence -- remoteness of harm -- prison warders negligently allowing prisoners to escape -- during course of escape, prisoner intentionally shooting plaintiff, a member of the public who happened to be near the scene -- damage suffered by the plaintiff not too remote for Minister of Correctional Services to be held liable to the plaintiff.

 Costs -- merits decided as a separate issue at the outset -- declarator  in favour of the plaintiff -- whether plaintiff should be awarded costs at that stage or whether costs should stand over until determination of damages.

Constitutional Law - Majority view - s. 172 (1)(a) and (b) of the Constitution are to read conjunctively and not disjunctively (Erasmus J dissenting) - Constitutional Court having made an order under s. 172(1)(b) in S v Steyn 2001 (1) SA 1146 (CC) suspending the declaration of invalidity relating to s. 309 B and 309 C of the Criminal Procedure Act - no room for this Court to make a further order under s. 172 (1)(b).

Criminal Procedure - right of appeal of an accused convicted and sentenced in the Magistrate's Court on or before 28 May 2001 whereafter the declaration of invalidity in S v Steyn came into effect - the declaration of invalidity not retrospective in effect and only effective as from 29 May 2001 - accused persons convicted and sentenced before that date having to apply for leave to appeal under s. 309 B or 309 C - the approach in S v Jaars 2002 (1) SACR 546 (C) approved while that followed in S v Thusi 2002 (12) BCLR 1274 (N) and S v Danster 2002 (2) SACR 178 (C) disapproved.

Criminal Law and Procedure - accused convicted in Regional Court but committed for sentence by High Court under s. 52 (1) of the Criminal Procedure Act - after sentence in the High Court the accused applied for leave to appeal against conviction - distinction between the procedures under s. 52 where the accused is convicted pursuant to a plea of guilty in the Regional Court and that where he has pleaded not guilty - whether in the High Court it is necessary for the judge to confirm a conviction where the accused has pleaded not guilty - ain this latter case the judgment of the Regional Court is not to beequated with that of the High Court in regard to conviction and the accused enjoys an automatic right of appeal from his conviction in the Regional Court but requires leave of the High Court to appeal against sentence - the anomalies of the situation highlighted and the hope expressed that the legislature will remedy deficiencies in the legislation.
