LRA Amendments

Changes to the LRA come into effect from 01 October 2014

Some of these amendments will need to be implemented immediately, and in the case of others, Rhodes will have 3 months to comply i.e. the changes will need to be in place by 1 January 2015.

These amendments will give staff employed on a fixed term contract more rights specifically those employed for longer than 3 months and whose basic cash earnings are below the earnings threshold as defined in section 6(3) of the Basic Conditions of Employment Act (BCEA. For 2014, this R205 433 per annum. This threshold is revised annually by the government.

A further protection for staff earning less than the threshold is that fixed term contracts (as opposed to permanent posts) must be justified. Justifiable reasons include a) replacing another employee who is temporarily absent from work; b) employing a person to deal with a temporary increase in the volume of work which is not expected to be beyond 12 months; c) a person who student/recent graduate who is employed to be trained or to gain work experience to enter a job/profession; d) employing a Non RSA citizen with work permit for defined period and e) those employed in position which is funded by an external source for a limited period.
